Abstract：
劳动监察是依法对用人单位遵守劳动法律法规的情况进行监督检查和处罚的行政行为。中国大陆和台湾的劳动监察制度各具特色。从立法进程、监察主体、监察范围和法定程序四个方面,比较分析了两岸的劳动监察法律制度。
