行政执法视角下的环境民事公益诉讼时效设定

Abstract :

环境民事公益诉讼属于公法诉讼,有别于民事私益诉讼,然而现有环境民事公益诉讼时效制度在理论探讨与司法实践中仍沿用民事诉讼时效的框架或规定,无助于解决该制度面临的困境.环境民事公益诉讼是为解决行政失灵应运而生,应回归到公法制度下考察.本文认为,环境民事公益诉讼与环境行政执法之间的制度架构共通,救济手段可相互替代,同美国环境公民诉讼与环保署执法行动间的关系类似.因此,可考察和借鉴美国环境公民诉讼适用行政执法时效的制度规范与实践,通过内部体系与外部体系的考量,证明环境民事公益诉讼适用行政处罚时效的优越性,并依据环境民事公益诉讼的特性和行政处罚时效的规定,完善环境民事公益诉讼时效制度的期间长度、起算点、终止以及延长规则.

Carbon Footprint Prediction of Thermal Power Industry under the Dual-Carbon Target: A Case Study of Zhejiang Province, China SCIE SSCI

Abstract :

China is the world's primary energy consumer. In order to address global warming, China has proposed a strategic goal of "reaching peak carbon and carbon neutrality", which is related to a balance between human and natural life and has vital strategic significance for accelerating the construction of a sustainable society and achieving high-quality development. The energy sector is the main battlefield upon which the country will strive to achieve the "double carbon" goal, and power systems take the hierarchical first place in the current carbon emissions structure in China. Thermal power enterprises are facing severe challenges, such as low-carbon development, transformation, and upgrading. Therefore, it is crucial to study the thermal power industry's carbon footprint. A scenario prediction method for estimating the carbon footprint of the thermal power industry in Zhejiang Province based on stacking integrated learning-i.e., the STIRPAT model-is proposed in this study. Using this model, to identify the main influencing factors, one can take the coefficient of determination (R-2) and mean absolute percentage error (MAPE) as evaluation indicators, building a fusion advantage model to predict the carbon footprint. Four carbon peak action scenarios are set up to determine the thermal power industry's carbon peak in 2021-2035, taking Zhejiang Province as an example. The findings indicate that the proposed method can accurately predict the carbon footprint of the thermal power industry, with the prediction coefficient (R-2) being higher than 0.98 and the error (MAPE) being lower than 0.01. The carbon emission peaks of the thermal power industry under different carbon peak action scenarios are calculated, verifying that Zhejiang Province can reach the goal of a carbon peak; however, the low-carbon development model is too extreme and needs to be revised in combination with more reasonable improvement methods. Therefore, Zhejiang Province must be restructured industrially, the construction of high-tech industries must be encouraged, the energy consumption structure must be optimized, energy efficiency must be boosted, and energy use must be reduced. Relevant research offers a theoretical foundation and benchmark for China's thermal power industry to promote industrial restructuring and low-carbon transformation by means of comprehensive governance.

<正>习近平总书记在2018年的全国生态环境保护大会上强调,用最严格的制度、最严密的法治保护生态环境。具体而言,就是要用科学的立法、公正的司法和严格的执法保护生态环境。这些无疑都需要理论支撑。为此,学术界进行了不懈努力,尤其是针对生态环境的公共性(公益性)这个焦点问题如何进行法律调整,提出了许多学说,如公众共用物说、环境法权说、环境使用权说、环境利益说、准物权说、准用益物权说、物格权说等。然而,这一问题尚未根本解决,仍有讨论的空间。首先,生态法治实践需要环境法学理论指导。

Based on the complex geographical environment of river basins and the top-down environmental management system, China has launched the characteristic river chief system. Taking the Yellow River basin as an example, this study focuses on the implementation of the river chief system in the Yellow River basin, and investigates whether the river chief system can help improve the water environmental quality in the Yellow River basin. This study collected the data of water quality categories of the river basin, main stream and main tributaries and the sections of the Yellow River basin with major pollution indicators exceeding the standard since the implementation of the river chief system in various provinces of the Yellow River basin, in order to analyze whether the river chief system has promoted the improvement of water environmental quality in the Yellow River basin, and analyzes the advantages and disadvantages of the river chief system from the aspects of the construction of the river chief system norms and institutional Settings. The study found that, firstly, the river chief system effectively improved the water environmental quality of the Yellow River basin. Secondly, the river chief system integrates the environmental power in the basin and changes the traditional fragmented management mode. Thirdly, the system of river chief has some shortcomings in the management of trans-provincial rivers and external supervision, and lacks the long-term effect of the system. Finally, this study puts forward some suggestions on how to improve the river chief system, especially how to make the river chief system more long-term.

Abstract :

当前,地方环境立法在立法前中后三阶段分别面临着回应地方现实情况不足、法律责任条文不够精准有效、立法评估缺乏科学工具等可望引入大数据技术解决的问题。大数据技术因其数据处理能力契合地方环境立法特点,可内嵌于地方环境立法过程,在一定范围内辅助地方环境立法。大数据技术可为回应环境现实情况、衡量法律责任、协助立法评估等地方环境立法中的技术层面问题提供有效手段。现阶段地方环境立法中大数据技术的应用,应当加强地方环境立法相关领域各层级的主体协同,推动大数据技术面向地方环境立法的迭代和规范建设,预防地方环境立法中的大数据技术依赖。

我国检察公益诉讼中检察机关既是诉讼监督者又是诉讼当事人,此双重角色具有法理冲突。我国《宪法》将检察机关定位为国家法律监督机关,检察权发挥着法律监督功能。检察机关通过检察权的执法监督权能、司法监督权能、守法监督权能实现其各项职能,且每类监督权能由检察机关若干职权构成。检察权的三类法律监督权能无须在检察机关的每项活动中同时实施,构成权能的具体职权也应随着法律实施的需要而动态调整。在检察公益诉讼中,为解决双重角色的法理冲突,检察机关应主要实施执法监督权能和守法监督权能,谦抑地实施司法监督权能。故可取消司法监督权能中的抗诉职权,并转隶司法工作人员侵犯公民权利、损害司法公正犯罪的立案侦查职权至监察委员会...

Fusing XGBoost and SHAP Models for Maritime Accident Prediction and Causality Interpretability Analysis SCIE

Abstract :

In order to prevent safety risks, control marine accidents and improve the overall safety of marine navigation, this study established a marine accident prediction model. The influences of management characteristics, environmental characteristics, personnel characteristics, ship characteristics, pilotage characteristics, wharf characteristics and other factors on the safety risk of maritime navigation are discussed. Based on the official data of Zhejiang Maritime Bureau, the extreme gradient boosting (XGBoost) algorithm was used to construct a maritime accident classification prediction model, and the explainable machine learning framework SHAP was used to analyze the causal factors of accident risk and the contribution of each feature to the occurrence of maritime accidents. The results show that the XGBoost algorithm can accurately predict the accident types of maritime accidents with an accuracy, precision and recall rate of 97.14%. The crew factor is an important factor affecting the safety risk of maritime navigation, whereas maintaining the equipment and facilities in good condition and improving the management level of shipping companies have positive effects on improving maritime safety. By explaining the correlation between maritime accident characteristics and maritime accidents, this study can provide scientific guidance for maritime management departments and ship companies regarding the control or management of maritime accident prevention.

我国生态环境损害赔偿权利人权源的法理透视

关于生态环境损害赔偿权利人权源问题,现行法律规定持自然资源国家所有权说,其他既有学说还有国家环境保护义务说、环境行政执法权能说、环境公益说、公共信托说等几类.现行法律规定和以上学说均不能完美解释生态环境损害赔偿制度的救济客体、诉权基础、行政权与诉权关系等法理问题,从而不能明晰生态环境损害赔偿诉讼与其他环境诉讼的关系,造成环境司法制度体系的紊乱.生态环境损害同时侵犯具有"经济性"的自然资源国家利益和具有"生态性"的社会环境公共利益.根据现行制度安排和法理,生态环境损害赔偿制度救济的利益是"生态性"利益而非"经济性"利益,是社会环境公共利益而非自然资源国家利益,两类利益有必要区分.救济的权利是以"生态性"利益为客体的公民环境权而非以"经济性"利益为客体的自然资源国家所有权.现行制度规定的生态环境损害权利人不享有"生态性"利益,没有环境实体权利,其在生态环境损害赔偿诉讼中的地位是法定诉讼担当人,依据法定诉讼担当制度提起诉讼.
