Abstract:
完全竞争市场等经济学理论表明,互不挖角协议对劳动力市场产生了明显的限制竞争效果,且该效果会不可避免地传导至产品市场.同时,互不挖角协议对劳动者权益带来的负面影响与反垄断法所保护的公共利益相抵触,特别是高科技领域的互不挖角协议将极大地抑制用人单位的创新能力和生产效率.对于互不挖角协议,我国反垄断法可做出有效的制度因应:一是明确将劳动力市场纳入反垄断法的规制范围,二是确立用人单位的反垄断法适用主体地位,三是在《禁止垄断协议》中增设互不挖角协议条款,四是引入快速审查原则作为违法认定原则.
