Abstract：
环境权益是公众对环境享有的包括日照权、清洁空气权、清洁水权、优美景观权等法益。环境侵权行为不侵害环境权益,侵害环境权行为才侵害环境权益。因此,环境权益不能通过侵权法来救济,只能通过环境法及其他公法得以救济。
