Abstract：
环境侵权作为民事侵权的一种,在性质上属于特殊民事侵权行为。但是对于该特殊侵权行为的责任构成要件,无论是民法通则还是最近新出台的侵权行为法都没能统一标准,致使学界对于违法性要件、无过错要件、因果关系的推定和损害事实要件等都存在较大分歧。
