Abstract：
相对人协助义务因理论基础和现实需要构成其正当化的依据,在具体类型上分为作为义务与容忍、服从义务。相对人协助义务的合理配置,核心在于行政机关的行政调查职能与相对人权利保障之间的平衡,包括相对人应具备协助之行为能力、明示制度、采取最小的损害之手段、拒绝履行协助义务的法律后果。
