一直以来,国有企业以其管理独特的经营模式、产权构成,在市场经济中进行经营管理,通过民事法律关系实现其特殊的公共性职能,在民事主体中占据一定地位。厘清国有企业民事主体性质问题,对于编撰民法典过程中的民事主体制度的构建有着重要意义。
