Abstract：
通过分析“工业品外观设计”和“实用艺术品”两者的法律含义和关系，“外观设计”应属“实用艺术品”中具有新颖性的那部分。剖析了我国实用艺术品保护的法律保护框架及立法缺陷，探讨了实用艺术品保护的设想。在目前我国的法律环境下提出了利用知识产权保护“实用艺术品”的实务策略。
