Abstract：
小产权房是指城市居民私自向农民购买建造在农村集体土地上的住房。小产权房的产生的原因分为表层原因和深层原因。而现阶段应根据小产权房使用土地来源区别对待，而要真正解决小产权房非合法性，则要改变现行的城乡二元土地管理体制，允许农村集体土地有限度地在房地产市场进行自由交易并完善集体经济组织对集体土地的管理制度。
