Abstract：
2002年，上海市闵行区人民法院对国内首例夫妻“忠诚协议”案作出判决。但至今最高院仍对夫妻“忠诚协议”保持沉默。本文通过法律解释方法的运用，对判决的正确性进行评析。因“婚外情”这种违背夫妻忠实义务而订立的“忠诚协议”，只要内容不违反法律的禁止性规定和公序良俗，应当有效，无过错一方有请求离婚损害赔偿的权利，具体的赔偿数额应充分尊重当事人意思自治。
