Abstract：
本文以《约克——安特卫普规则》为理论依据,对承运人的过失与共同海损成立之间的联系、承运人不同的过失行为所导致的不同的法律后果、承运人过失难以确定时共同海损的分摊问题等进行了阐述和分析,并对我国海商法197条提出了完善建议.
