随着市场经济的发展及以《劳动法》《劳动合同法》为代表的劳动法律体系的日趋成熟,就业协议书由于缺乏明确的立法规定,其法律定位、责任承担在学理和实务中引起了很大争议,要妥善解决因就业协议引起的纠纷,必须明确就业协议书本身的法律性质。
