Translated Abstract
Drug patent compulsory licensing system is an effective measure to restrict the abuse of intellectual property rights. Though there are relevant provisions in China, the system was rarely implemented. Though sharing a similar situation with China, India has practiced compulsory licensing system for many times in the patent-protection-oriented inter- national environment. By introducing the case of India,the inadequacies in Chinese ＂Patent Law＂ is analyzed with the purpose of using the Indian example to provide certain advice to Chinese law-making.
