Abstract：
现行的《环境保护法》作为环境保护基本法带有明显的行政管理色彩，与当今环境保护立法的趋势有悖。本文认为新《环境保护法》应该明确赋予公民环境权利，强调政府保障公民环境权义务作为立法模式，构建新的环境保护基本法。
