Abstract：
环境问题作为21世纪的首要国际问题,体现在法律上催生了一系列新兴的、重要的、独特的权利.国际上许多国家通过高位阶的国内法明确环境权.在我国,环境权内容散见于低位阶的地方环境立法中,急需高层次立法予以指导和保护.应明确环境权的保护主体包含当代人和世代人,内容包括基础环境权利和派生权利.在宪法中抽象性规定公民享有环境权利,在环境基本法中用列举方式规定公民环境权的具体内容.
