Abstract：
环境损害具有特殊性,从源头预防环境损害,已成为保护环境的重要途径,具有天然优势性.然而,侵权责任法以保护私益为目的,因果关系证明标准模糊、对预防环境损害作用不足.因此,释放社会化救济的预防功能,建立专项预防基金,以发展绿色技术,帮助企业治污为主要目标,并发挥政府主导作用,社会主体参与监督,从根本上实现环境预防.
